DWI San Antonio, Texas laws, penalties, definitions and legal advice.  Texas penalties for driving while intoxicated can put you in a world of hurt.  Texas state laws mandate that blood alcohol levels of .08 is over the legal limit. That means drinking 2-3 beers in an hour will render you legally drunk (We recommend that if you have even one drink you avoid driving).  If you plan to have even one sip of alcohol you should not plan to drive.  Avoid legal penalties and risk of life…..call a cab or have a designated sober driver every time.
 
DWI Penalties
Texas DWI Law: State Statute has penalties that including but not limited to those below.
License Suspension/RevocationA minimum mandatory penalty is imposed on drivers whose BAC is above the state limit for intoxication, or drivers who refuse to submit to BAC testing.  Suspension or revocation of a driver's license is usually carried out by a state agency (such as a Department of Motor Vehicles), distinct from any criminal court penalties. More harsh penalties are imposed for second or third DWI offenses, typically defined as those that occur within five years of a prior DWI offense.

Note: the penalties identified here do not include variations for DWI offenders operating commercial vehicles, or drivers who have violated "zero tolerance" and "enhanced penalty" DWI laws.

Vehicle ignition interlock breath-testing device may be required.  This device measures a vehicle operator's BAC, and will prevent operation of the vehicle if more than a minimal amount of alcohol is detected (i.e. BAC level of .02).  The offender is required to pay the costs of installation, rental, and maintenance of an ignition interlock device.

If you get pulled over by the police and they request you take the sobriety test AND YOU THINK YOU MAY BE OVER THE LEGAL LIMIT, then, it may be best to deny the test.  Sobriety test can be difficult for a sober person to pass.  So you may politely decline the test saying, "I have heard these test can be difficult and subjective.  For that reason I decline the test. I would like to contact my attorney before discussing anything else."  DO NOT take any test and DO NOT speak to the officer any more.
